FBT Gibbons served as co-trial counsel for INOVIO Pharmaceuticals Inc. in litigation that resulted in an $80.4 million judgment against VGXI Inc. and GeneOne Life Science Inc. in the Court of Common Pleas of Montgomery County, Pennsylvania.
The court ruled in INOVIO’s favor on all claims, awarding approximately $61.75 million in compensatory damages and $18.67 million in fees and costs. The court also entered judgment against the defendants on their counterclaims.
The judgment follows litigation dating to June 2020 involving a supply agreement dispute over technology transfer obligations. INOVIO alleged that the defendants breached the agreement by refusing to fulfill obligations necessary to enable scalable manufacturing of DNA plasmids used in the development of DNA medicines.
