U.S. Supreme Court 2025-26 Term: History in the Making

Welcome to FBT Gibbons’ survey of rulings from the United States Supreme Court’s 2025-26 term. As is now customary, this survey does not address every case decided during the term. Rather, the survey is focused on those rulings that are likely to be most relevant to the industries and clients we serve.

The 2025-26 term reflected some of the major political and economic issues of our time. The Supreme Court reaffirmed the Fourteenth Amendment’s guarantee of birthright citizenship. And it stuck down the Trump administration’s widespread tariff regime under the International Emergency Economic Powers Act. But the court also affirmed that the president may remove commissioners of the FTC without cause — and that any statutory attempt to constrain that discretion violates the separation of powers.

Beyond the political machinery of the republic, the Supreme Court addressed conversion therapy (under the First Amendment), Hawai’i’s gun laws for private property (under the Second Amendment), “geofence” warrants (under the Fourth Amendment), pesticide warnings (under the Supremacy Clause), and statutory limits on the participation of transgender girls and women in sports at public schools (under the Equal Protection Clause).
