Alternative Dispute Resolution

Concerns about the expense and delay associated with traditional litigation in state and federal judicial systems have led to a national movement seeking alternative forms of dispute resolution.

Alternative Dispute Resolution (ADR) forums are increasingly preferred over court proceedings because they can provide faster, more cost-effective, and more confidential resolutions of disputes.

In some cases, ADR forums may also allow the parties to select mediators and arbitrators whose specialized knowledge and experience fit the issues involved. Navigating ADR forums, however, requires experience and a unique skill set, as the rules and procedures are varied and detailed.

The FBT Gibbons ADR team regularly advises on a diverse range of ADR proceedings nationwide. In addition, our attorneys serve as neutrals and in other court-appointed roles in a variety of settings, including:

  • Mediation
  • Arbitration
  • Special Master
  • Receiver
  • Special Fiscal Agent / Custodian
  • Bankruptcy Examiner
  • Executor/Administrator
  • Compliance Monitor
  • Moot Courts/Mock Trials

As advocates, we represent clients in high-stakes disputes across a broad range of ADR forums, including the American Arbitration Association (AAA), JAMS, Financial Industry Regulatory Authority (FINRA), International Institute for Conflict Prevention & Resolution (CPR), the International Chamber of Commerce (ICC), and numerous other kinds of voluntary and/or court ordered ADR proceedings.  Our team includes attorneys with deep knowledge and significant experience in many industries, including Energy, Finance, and Manufacturing.

As third-party neutrals, our team brings together nationally recognized leaders in law and public service—including a former Chief Justice of the New Jersey Supreme Court and a former New Jersey Attorney General. FBT Gibbons attorneys regularly serve as neutrals in high-stakes proceedings before AAA, and other nationally recognized ADR platforms.

This experience at the highest levels of the judiciary and government, combined with deep, collective Industry knowledge and litigation background, positions us to navigate complex disputes with authority, insight, and credibility, whether as third-party neutrals or zealous advocates on behalf of our clients. The result is a trusted ADR practice known for delivering thoughtful, effective resolutions in the most challenging matters.
